This Privacy Policy explains the practices and policies of 4D Global Partners, LLC ("4DGP") regarding the collection and protection of Personal Data (defined below) supplied by users or collected by us from users of 4DGP websites, including, without limitation, onlinebackupfordummies.com, 4DGP.com, and the Online Backup For Dummies backup services (the "Service").
The 4DGP websites are owned by 4DGP. All content presented on these Web sites are the exclusive property of 4DGP, including all software, text, images, graphics, video and audio used on the Web site.

This Privacy Policy may be updated by 4DGP from time to time. 4DGP will provide notice of materially significant changes to the Privacy Policy by posting notice on its websites.
By registering to use the Service, you agree (1) to comply with the terms and conditions of this Privacy Policy and (2) that 4DGP may process (i.e., collect, use, etc.) your Personal Data as described in this Privacy Policy or the User Agreement. Personal Data may be processed by 4DGP in the country where it was collected as well as other countries (including the United States) where laws regarding processing of Personal Data may be less stringent. By agreeing to the Terms and using, installing, or accessing the 4DGP Products, you are agreeing to this Privacy Policy and the terms contained herein.
Unauthorized use of the materials appearing on 4DGP’ Web sites may violate copyright, trademark and other applicable laws, and could result in criminal or civil penalties. 4DGP may monitor access to their Web site.
Personal Data
Cookies and Passive Data Collection
4DGP uses cookie, IP address, and URL information to improve and further develop the Service, and to provide enhanced or geographically differentiated features and service levels to Users, where available. 4DGP uses cookies to save User screen names, session validators, and on Users' browsers and hard drives, and may use them to provide tailored products and services to those Users, as they become available.
IP Addresses also help us diagnose network congestion, problems with our servers and otherwise assist in the administration and delivery of the Service to our Users.
4DGP automatically receives and records information on our server logs from your browser, including your IP address, cookie information, and the page you request.
Users should be aware that other websites visited before entering the 4DGP websites might place Personal Data within a User's URL during a visit to their website, and 4DGP has no control over such websites. Accordingly, some of this information may be logged by 4DGP.
Personal Data
Once you register with 4DGP and sign in to the Service, you are not anonymous to 4DGP.
When registering with 4DGP, you provide Personal Data, which may include company name, industry, number of employees, phone number, your title, city, state, country, zip code, a user name, confirmed email address, and a password. When backing data up with the Service, you send us that data and you also are sending file system information, including names of files and directories. 4DGP may also record your IP address when you submit information.
4DGP also may collect, at your option, certain preference and demographic information from you.
All information collected by 4DGP is used for internal purposes of providing the Service, providing support to users, and to improve services. Aggregating non-identifying information supplied by users allows 4DGP to understand its user base and to improve services.
To protect your account information, please keep your password secure.
All Users may opt to remove their Personal Data from our live database by contacting 4DGP and canceling their 4DGP user account. Users of the onlinebackupfordummies.com Services may also cancel their user account.
4DGP does not intentionally gather Personal Data about visitors who are under the age of 13.
We
will not sell or market the email addresses or other collected personal information of registered Users to third parties.
We
will not view the files that you backup using the Service.
We
may view your file system information (file extensions, sizes etc. but not your file contents) to provide technical support.
You acknowledge and agree that 4DGP may occasionally send you administrative communications regarding your account or the Service via email.
Links to Third Party Sites
4DGP websites may contain links to other sites that are not under our control. These websites have their own policies regarding privacy. You should review those policies before visiting the websites. We have no responsibility for linked websites, and we provide these links solely for the convenience and information of our visitors.
4DGP Service Providers
4DGP does not disclose Personal Data to third parties, except to process credit card information for orders. However, at a future time, 4DGP may need to provide users' Personal Data to other third parties to deliver specific services to the user (such as hosting services or support services). These third parties will be required to adhere to Safe Harbor Privacy Principles or at a minimum 4DGP will require the third party to certify they follow privacy protection equal to 4DGP's. Users will also be provided with a mechanism to opt-out of having their Personal Data viewed by such third parties.
Legal Requirements
4DGP does not disclose Personal Data, including the data you back up with the Service, unless disclosure is necessary to comply with an enforceable government request such as a warrant.
4DGP may terminate the user's access to the Web site at any time, for any reason. The provisions regarding disclaimer of warranty, accuracy of information and indemnification shall survive such termination.
4DGP shall bear no responsibility for any damage to the user's computer system or any loss of data that may result from the download of any content, materials or information from the Web site.
4DGP may unilaterally change or discontinue any aspect of the Web site at any time, including its content or features.
4DGP will not be liable for damages of any kind including, without limitation, direct, incidental or consequential damages (including, but not limited to, damages for lost profits, business interruption and loss of programs or information) resulting from the use of or inability to use the Web site, or any information provided on the Web site, or for any other reason whatsoever.
The user agrees to indemnify, defend and hold 4DGP harmless from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from, or relating to, any misuse by the user of the content and/or services provided on the Web site.
The information contained on the Web site has been obtained from sources believed to be reliable. 4DGP disclaims all guarantees regarding the accuracy, completeness or adequacy of such information.
4DGP makes no guarantee that:

c)the results that may be obtained from the use of the Web site or any services offered through the Web site will be accurate or reliable.
Change of Ownership
In the event of a change in ownership, or a direct merger or acquisition with another entity, we reserve the right to transfer all of 4DGP User information, including Personal Data, to a separate entity. We will use commercially reasonable efforts to notify you (by posting on our website or an email to the email address you provide when you register) of any change in ownership, merger or acquisition of 4DGP's assets by a third party, and you may choose to modify any of your registration information at that time.
4DGP uses industry standard security measures to protect against the loss, misuse and alteration of the information under our control. Although we make good faith efforts to store the information collected by 4DGP in a secure operating environment that is not available to the public, 4DGP cannot guarantee complete security. Further, while we take reasonable steps to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "crackers" from obtaining this information.
You may, at any time, choose to correct or update the information you have submitted to 4DGP by updating your account on our website.
If you cancel your account, your Personal Data and other information may be retained in our archive or backup records.
If you have a dispute or complaint about privacy on a 4DGP website, we kindly ask that you attempt first to resolve the issue directly with 4DGP by emailing info@4dgp.com.
4DGP has instituted measures and mechanisms to ensure adherence to the European Union Safe Harbor Privacy Principles. Among other requirements, adherence involves engaging an independent third party to resolve privacy disputes. If you are a European consumer and feel your privacy dispute or complaint has not been adequately resolved, the Council of Better Business Bureaus has been contracted by 4DGP to handle complaints that allege a failure to comply with the Safe Harbor Privacy Principles.

4DGP reserves the right in our sole discretion to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification of this policy will be posted on 4DGP websites, and a User's continued use of the Service will signify agreement to such changes.
